Terms and conditions of sale

Article 1 - Purpose

These general terms and conditions (GTC) govern the contractual relationship between OpsForm, a professional training organization, and any individual or legal entity wishing to benefit from its services (hereinafter referred to as "the Customer").

Article 2 - Services offered

OpsForm offers professional training in the aeronautical field and associated services (coaching, certification, etc.).

Article 3 - Order and registration

Registration for a training course implies full acceptance of these terms and conditions.

All orders become firm and definitive after signature of a quotation, a training agreement or validation of an order form.

Article 4 - Rates and payment terms

Prices are given in euros and are net of tax, as OpsForm is not subject to VAT.

Payment can be made by bank transfer, cheque or any other means accepted by OpsForm.

A deposit may be required on registration.

Article 5 - Withdrawal period

In accordance with article L221-18 of the French Consumer Code, the individual customer has a period of 14 days to exercise his right of withdrawal, unless the training has begun before the end of this period with his agreement.

The right of withdrawal does not apply to continuing professional training (corporate customers).

Article 6 - Cancellation, withdrawal or abandonment

In accordance with article L6353-5 of the Labor Code and article 1218 of the Civil Codethe conditions for cancelling or abandoning the course are specified as follows:

In the event of cancellation by the beneficiary less than three 3 clear days before the start of the training session, or in the event of withdrawal during the session, the following provisions apply:

  • Sums paid on account or in part remain the property of the training organization. No refund, total or partial, will be made.
  • The outstanding balance may be invoiced up to a maximum of 40% of the total cost of the course, except in the case of duly justified force majeure.
  • In exceptional circumstances, and at the request of the beneficiary, the training organization may offer a deferral to another session within the limit of available places and within a maximum period of one year.
  • The sums due under this clause cannot be financed by public or joint funds (OPCO, France Travail, etc.) and remain the sole responsibility of the beneficiary.

Force majeure, within the meaning of article 1218 of the French Civil Code, means external, unforeseeable and irresistible events making it impossible for the beneficiary to participate, such as :

  • Serious illness or accident with medical certificate,
  • Death of beneficiary or close relative with death certificate,
  • Natural disasters or major adverse weather conditions preventing travel, with proof,
  • Unexpected administrative or judicial summons,
  • Unexpected redundancy or job transfer with proof of employment.

Apart from these situations, any voluntary or unjustified withdrawal does not constitute a case of force majeure and entails the full application of the present provisions.

Article 7 - Liability

OpsForm makes every effort to ensure the quality of its training courses. OpsForm cannot be held liable in the event of force majeure or misuse of the knowledge transmitted.

Article 8 - Intellectual property

All training materials are the exclusive property of OpsForm. They may not be reproduced, distributed or used without prior written consent.

Article 9 - Personal data

OpsForm is committed to complying with applicable regulations on the protection of personal data (RGPD).

A specific privacy policy is available on the site.

Article 10 - Applicable law and jurisdiction

These GTC are governed by French law.

Any dispute will be subject to the exclusive jurisdiction of the courts of Bordeaux.

Article 11 - Daily training duration

Daily training times may vary according to program, trainee level and teaching constraints.

Training sessions are organized on the basis of 5 to 7 hours per day, including breaks.

This amplitude complies with the provisions of article L6353-1 of the French Labor Code concerning the implementation of continuing professional training initiatives.

Article 12 - Adapting training methods (face-to-face / distance learning / e-learning)

The training organization reserves the right, insofar as is possible and without altering the quality of the training, to modify the initially planned face-to-face training, in order to ensure its continuity via videoconferencing or e-learning.

This adaptation complies with the provisions of article L6313-2 of the French Labor Code, which recognizes distance learning and on-the-job training as equivalent methods of implementing vocational training initiatives.

In this context :

  • The objectives, content and duration remain identical to those of the face-to-face course,
  • The trainee or the company is informed in advance by e-mail,
  • The trainee's remote participation is equivalent to effective presence for pedagogical and administrative follow-up.
